Tree Preservation Orders
Local Authorities have the power under the Countryside and Rights of Wat Act 2000 to create a Tree Preservation Order (TPO). These may be on individual trees, groups of trees, or woodlands. The purpose of a Tree Preseravtion Order is to protect trees against removal or improper pruning that would result in a significant loss of amenity value.
Before removing or commencing any work to protected trees, permission must be obtained from the Local Planning Authority. This process usually takes eight weeks from the date of submission of a formal application to arry out works to protected trees.
Failure to do so could potentially result in a fine and/or a criminal record.
Callophrys Tree Consultants are able to act as agents on your behalf. Our professional tree reports identify what statutory protection is applicable, and we will be able to advise as to what works are likely to be permitted. With your approval, we search for statutory designations, engage with the Local Plannining Authority and, if necessary, meet with the Local Authority Tree Officer on site to discuss any proposed works.
We are not able to guarantee permission, but our experience means that applications tend to be addressed in a professional manner.
